Why is disability a protected characteristic?

Opportunities should be available to all, irrespective of whether or not individuals have a physical or mental impairment, which has a substantial, and long-term adverse effect on their ability to carry out normal day-to-day activities.

Types of Discrimination

Discrimination can take place on the basis of physical or mental disability in various aspects of employment either in workplace relations, opportunity for progression, hiring etc.

Discrimination can occur via association i.e. not being offered equal treatment due to caring for a disabled dependant.

Discrimination can also arise based on the impacts of an individual’s disability, i.e.needing to take time for medical appointments, not including someone in social events who may have a neuro diverse disabilitye.g. (Autism, Asperger’setc).

Discrimination can also occur when a disability is assumed.

What does the Equality Act 2010 say about disability?

The Equality Act 2010 says that you must not be discriminated against because:

You have a disability
Someone thinks you have a disability (this is known as discrimination by perception)
You are connected to someone with a disability (this is known as discrimination by association)

It is not unlawful discrimination to treat a disabled person more favourably than a non-disabled person.
